Initial Comments:


An off-site follow-up survey conducted on August 23, 2022, found that Guardian Angel Staffing, LLC, had not corrected the following deficiency cited under 28 Pa. Code, Health Facilities, Part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries. The deficiency was cited as a result of an off-site state re-licensure survey conducted on April 29, 2022.

Criminal Background Checks

Name - Component - 00
The home care agency or home care registry shall require each applicant for employment or referral as a direct care worker to submit a criminal history report obtained at the time of application or within 1 year immediately preceding the date of application.

Observations:


Based on a review of the agency's plan of correction (POC), multiple emails and phone calls sent to agency it was determined that Guardian Angel Staffing, LLC had not corrected the deficiency found during their initial survey on April 29, 2022.

The agency's POC dated May 3, 2022, indicated that the following corrections would be implemented by May 3, 2022: (1) a three-check process of personnel files would be created to ensure the agency ' s hiring policy was followed before an offer of employment was made, and (2) personnel files would be reviewed to ensure the agency's hiring policy was followed and confirmed employees' background checks were on file.

An email was sent to the agency on June 16, 2022, requesting agency to provide documentation on or before June 24, 2022 to provide evidence that the plan of correction was implemented and the deficiency corrected. The agency failed to provide requested documentation on June 24, 2022. A telephone call was made to the agency on June 24, 2022, there was no answer,a voice mail.was left. The agency did not return the phone call. Additional emails were sent to the agency on July 11, 2022, July 25, 2022, July 29, 2022, and August 8, 2022, in addition to another phone call on July 25, 2022, requesting POC documentation.

The agency failed to provide the above requested documentation on June 24, 2022, June 28, 2022, July 11, 2022, July 25, 2022, July 29, 2022, or August 8, 2022.

As a result of the agency's failure to provide evidence of implementation of its plan of correction and correction of the deficiency cited during the April 29, 2022 licensure survey, the deficiency remains uncorrected.












Plan of Correction:

Pre-Offer Compliance Check:
Prior to extending an offer of employment, a preliminary review of the candidate's personnel file would be conducted to ensure that all necessary documents and information are present.
This includes verifying that the candidate has submitted a complete application and any other required documents outlined in the agency's hiring policy.

Hiring Policy Adherence Review:
Once an offer is tentatively accepted, a thorough review of the personnel file will be performed to ensure strict adherence to the agency's hiring policy.
This check confirms that the candidate has completed all required pre-employment screenings, certifications, and other prerequisites specified in the hiring policy.
It also involves validating that a background check has been completed and is penning final approval for employment.

Background Check Verification:
As part of the final pre-employment check, a comprehensive review of the candidate's background check results would be conducted to ensure they align with the agency's standards.
This involves confirming that all required background checks, such as criminal history and other relevant screenings, have been completed and documented appropriately.
Any discrepancies or issues identified during this process would be addressed before finalizing the hiring decision or making an offer to candidates.
Candidates will only work after the Manager's final approval signature on file indicating that they are ready to work.
